Enugu State Government Taken to Court Over Land Grabbing/Trespass at Likke Iheaka/Imilike in Udenu LGA.

Plaintiffs claim N500,000,000.00 (Five Hundred Million Naira) in damages.

Some indigenes of Likke Iheaka and Imilike in Udenu Local Government Area of Enugu State have propelled a suit against the Government of Enugu State, the Attorney-General of the State, the Commissioner for Lands, and the Commissioner for Housing and Urban Development claiming the sum of N500,000,000.00 (Five Hundred Million Naira) as damages for the displacement, embarrassment, and destruction of their lands and properties.

The Plaintiffs in suit No. OB/21/2020 and E/361m/2020 (the latter, an offshoot of the former) filed contemporaneously with the motion ex parte and a motion on notice are seeking for order interim and order interlocutory respectively.

Their contention is that they are the bonafide owners of the lands in question situate at and known as Agunkwo - immediately adjoining the proposed site for the Igboano General Hospital, and that the defacing of same by the government of Enugu State and their privies without notice, infringes on their constitutional rights to ownership of property.

Arguing the ex parte motion in E/361m/2020 pending at Enugu State High Court on 24/8/2020, for the order interim, Oscar Mba, Esq. (holding the brief of Chief B. C. Igwilo, SAN, counsel to the Plaintiffs/Applicants) moved the Court to grant the order interim sought inter alia, and preserve the res, pending the determination of the motion on notice.

Counsel to the Defendants/Respondents N. I. Ezenweokwe prayed the Honourable Court to sheath its sword and allow the Defendants to be heard. The Court therefore ordered that the Defendants be put on notice and adjourned to 8/9/2020 for hearing of the motion for interlocutory injunction.

    2. In as much as we know that the Governor of a State can take over possession of land in his state for overriding public interest, Enugu State Government should be made to know via the court action that same should not be abused.

  2. They are not idiots.The truth is that land in a state,belongs to the governor of that state;& can be taken by that governor, purely on overriding public interest.
